Terms and Conditions

§ 1 Scope of Application

These Terms and Conditions apply to all orders placed via the online shop at yateclo.com. The sole contractual partner is Yannik Stumpf, YATE Clothing Company, Worringer Straße 32, 40211 Düsseldorf, Germany (hereinafter referred to as the "Provider"). These Terms and Conditions apply exclusively to consumers within the meaning of § 13 of the German Civil Code (BGB).


§ 2 Formation of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. By submitting an order, the customer makes a binding offer to purchase. The Provider will confirm receipt of the order by email. The purchase contract is concluded upon dispatch confirmation.


§ 3 Prices and Payment

All prices are final prices in euros and include the applicable statutory value-added tax. Additional shipping costs may apply and will be clearly indicated before the order is completed.

  • Google Pay

Payment is due in full at the time the order is placed.


§ 4 Delivery

The Provider ships worldwide. After dispatch, delivery typically takes 5–7 business days. Variations in delivery times for international shipments are possible. The Provider is entitled to make partial deliveries, provided this is reasonable for the customer.


§ 5 Retention of Title

All delivered goods remain the property of the Provider until full payment has been received.


§ 6 Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal. In addition, the Provider voluntarily grants an extended return period of 30 days from receipt of the goods. Full details are set out in the Cancellation Policy, which forms an integral part of these Terms and Conditions.


§ 7 Statutory Warranty

The statutory warranty rights apply. In the event of a defect, the customer is entitled in the first instance to subsequent performance (repair or replacement delivery). If subsequent performance fails, the customer may withdraw from the contract or reduce the purchase price accordingly.


§ 8 Liability

The Provider is fully liable for intent and gross negligence, as well as for damages arising from injury to life, body, or health. In all other respects, liability is limited to damages that are foreseeable and typical for this type of contract.


§ 9 Data Protection

The collection and processing of personal data is carried out in accordance with the Provider's Privacy Policy, which is available at yateclo.com/policies/privacy-policy.


§ 10 Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. The Provider is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.


§ 11 Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). To the extent permitted by law, the place of jurisdiction is Düsseldorf, Germany.
